General and specific contracting conditions

OBJECT

These general and specific conditions regulate the contracting of locker services owned by Trisanio, S.L. through the website www.locking.es, as well as through the touchscreen located at the Locking commercial premises in Madrid, Calle de Hortaleza, 15, and also their use. Furthermore, these conditions regulate the contractual relationship between Trisanio S.L. (owner of Locking lockers) and the User who contracts Locking’s locker service.

The parties shall be referred to interchangeably as Locking or Trisanio, S.L. (CIF: B56259542) and User or Client.

THE SERVICE

Locking offers its Users the possibility of renting any of its lockers for periods of calendar days (within the opening hours offered by Locking).
What types of lockers does Locking offer?
Locking offers three types of lockers:

  • Medium (M) Lockers, with dimensions of 580mm x 436mm x 293mm for lockers at C/Hortaleza 15, and 560mm x 410mm x 280mm for all other locations. These lockers can fit approximately 1 carry-on suitcase and a small backpack.
  • Large (L) Lockers, with dimensions of 580mm x 436mm x 560mm for lockers at C/Hortaleza 15, and 560mm x 410mm x 500mm for all other locations. These lockers can fit approximately 2 carry-on suitcases and a medium backpack.
  • Extra-large (XL) Lockers, with dimensions of 580mm x 436mm x 856mm for lockers at C/Hortaleza 15, and 560mm x 410mm x 820mm for all other locations. These lockers can fit approximately 4 carry-on suitcases, or one very large suitcase, or one large suitcase and one carry-on suitcase.

What can a User place inside their locker?

Within the limits established in this document (see “Limits on the use of lockers” section), a User may place any items they wish inside the rented locker(s).

How can a User know if there are free lockers at Locking?

This can be determined by accessing the website www.locking.es and initiating a reservation.

For how long can the same locker be rented?

The User may contract the locker rental service for a period of at least 1 day and a maximum of 365 calendar days, and this period must fall within the establishment’s opening months.

When can the User access the locker(s) they have rented?

The locker rental service will be accessible during the hours indicated at the commercial premises itself, every day of the week, 365 days a year from 00:00 to 23:59 hours. Outside the indicated hours, access to the lockers will not be possible, as the premises where they are located will remain closed for security and maintenance reasons.

Once the User has inserted items, can they only access the locker again to remove them?

No. Once the User has inserted items, they can access the locker as many times as they wish, always leaving it closed and empty and closed at the end of the rental period.

What is the price the User must pay per locker type/day?

1. Prices

The prices applicable to each product are those indicated on the website at the time of purchase. The final prices displayed on the website and on the touchscreen include VAT and refer to the rental of a locker (according to its size) from 08:00 AM to 07:59 AM on the following day.
Offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.

Locking reserves the right to make modifications to the website and the commercial premises at any time and without prior notice, and may update products and services daily depending on the market.

2. Payment Method

Purchases can be paid by any of the methods indicated on the website at the time of booking or on the touchscreen located at the commercial premises itself. Specifically, by credit or debit card.

How are lockers reserved and used?

The lockers offered through Locking are fully automatic.

Locker reservations can be made through the website www.locking.es.

The User must access the website www.locking.es and go to the reservations section. In that section, they must select the number of lockers, size, and reservation period. They must also enter their first name, last name, mobile phone number, and email address.

Once these Conditions are accepted and payment is made by card and the contract is completed, the User will receive confirmation of the contract via email and/or SMS on their mobile phone, along with the number of the reserved locker(s) and their security code to access both the premises and their locker(s).

On the day of the reservation, at the entrance of the commercial premises, the User must type the code sent to them by email and/or SMS when making the reservation into the touchscreen keypad next to the main entrance door. If the code is correct, the main door will open, and the User can access the commercial premises.

Once inside the commercial premises, the User must go to the touchscreen located on one of the lockers and re-enter the reservation code. If the code is correct, the reserved locker will open automatically.

Therefore, the User can only access their locker via the security code provided through the email and/or SMS sent to the phone number provided at the time of booking. For this reason, Trisanio S.L. is not responsible if the User incorrectly provides this information when making the reservation and does not receive the security code due to reasons attributable to the User.

Once the reservation number entered on the touchscreen is confirmed, the assigned locker will automatically open, allowing the User to deposit their luggage or other permitted items. The User must close the locker every time they open it, even when permanently removing their belongings.

What should the User do when they wish to end the reservation?

When the User wants to open the locker for any reason, via the touchscreen located at the commercial premises, the system will ask if they wish to open it and continue the reservation (for example, because they forgot to remove or insert an item) or if they wish to open it to empty it and end the reservation.

If the User wishes to end the reservation, they must select the option to open the locker to empty it and end the reservation. Once the locker has been emptied, they must leave it closed so that another User can reserve it.

In the event that the User selects the option to open the locker to empty it and end the reservation, the system will automatically unlock that locker so that it can be reserved by other Users.

If the User leaves items or any object inside the locker, Trisanio S.L. will not be responsible for what the new User of the locker does with the items left by the previous User inside the locker.

What can the User do if they experience any type of incident when using the locker?

In case of a breakdown, blockage, or any other type of technical incident in the use of the locker, as long as it is during business hours, the User will have access to Locking’s assistance service by calling +34613059701. This phone number will only handle technical incidents or breakdowns and not any other queries about locker use.

Can the User modify their reservation or withdraw from it?

Once the reservation has been made and confirmed, the User cannot modify or cancel it.

ACCEPTANCE AND PROOF OF ACCEPTANCE

The acquisition of products must be made through the website www.locking.es and expresses the full acceptance of each and every one of these General and Specific Conditions as they are displayed at that moment in the link that appears on the website itself and on the touchscreen, without the new developments that may occur in the clauses of the General Conditions subsequently being applicable to them.

From the moment of acceptance, the user acquires the status of Locking Client as described in these General and Specific Conditions. Any product or service subsequently offered by Locking must be subject to a new contract.

If the Client wishes to read the General Conditions in more detail, they can consult them on the Website.

Locking informs you that it archives the electronic documents in which purchases are formalized.

ACCESS AND RESERVATION

To contract the rental of Locking lockers, the following requirements must be met:

  • Be 16 years of age or older.
  • Complete the necessary data to complete the reservation and payment.
  • Accept these general conditions of service contracting and locker use.

The User must keep the code sent to their email and/or mobile phone provided by the Client, as it will be essential to enter the commercial premises, open the locker, and retrieve luggage.

SERVICE TERMINATION

The service will terminate when the User selects the option on the touchscreen to open the locker to leave permanently. In this case, the User must remove all items from inside the locker and leave it closed.

If the User has left items or any object inside the locker, Trisanio S.L. will not be responsible for what the new User of the locker does with the items left by the previous User in the locker.

USER OBLIGATIONS. LIMITS ON THE USE OF LOCKERS.

The User, by contracting Locking’s locker rental services, undertakes, in particular and without limitation:

  • To use the lockers solely for the purpose of depositing their own property that they need to temporarily store in a secure place.
  • To use the lockers diligently and, in particular, to ensure that the locker has been correctly closed when the User leaves the premises (after inserting or removing items). In the event that the User leaves their locker open with their belongings inside, Trisanio S.L. will not be responsible for their loss, theft, or damage that may have been caused.
  • Not to use the lockers for illegal or unauthorized purposes. In particular, the User undertakes not to store objects whose mere possession or trafficking is illegal (such as stolen objects, drugs, pornographic materials, or anything otherwise degrading to human beings, etc.).
  • Not to deposit any goods whose possession requires a license without said license or authorization (such as weapons).
  • Not to insert any type of material that is polluting or dangerous into the lockers (such as flammable objects or hazardous substances).
  • Not to use the lockers to deposit animals or any type of living or deceased being.
  • Not to insert food into the lockers, unless it is packaged food that cannot spill, stain the lockers, or produce odors of any kind in the Locking premises.
  • Not to provide their security code to any third party, being fully responsible for the breach of this obligation and its consequences. The reservation code is personal and non-transferable and can only be used by the person holding the reservation, and cannot be transferred to a third party when the reservation holder is going to collect their belongings from the commercial premises.
  • Not to use the lockers to deposit goods that are to be collected by a third party. Lockers should not be used as a means of trafficking goods between parties. This is a use not authorized by Locking.
  • To access the premises and remain therein solely for the purpose of accessing the rented locker and only to carry out a specific action in relation to the inserted items. The User may not remain on the premises longer than strictly necessary.
  • Not to eat or drink inside the premises.
  • To remove the items inserted in the rented locker(s) when the rental period ends.
  • To leave the lockers, at the end of the service, in the same state in which they were found and, in particular, to notify Locking via email at info@locking.es of any incident the User encounters in the use of the lockers or their condition.
  • Not to take photographs or videos inside the Locking premises (except for what is necessary to capture the reservation/security number) and, in particular and without limitation, not to take photos or recordings of the security mechanisms of the premises.
  • Not to include money, jewelry, technological items (tablets, computers, televisions, etc.) or goods of special value in the lockers, the user’s decision to use the rented lockers to store these types of goods of special value being their sole and exclusive responsibility.
  • To pay the locker price with a credit/debit card owned by them or with the authorization of its owner.

CONSEQUENCES AND USER RESPONSIBILITY IN CASE OF NON-COMPLIANCE WITH OBLIGATIONS

The User shall indemnify Trisanio S.L. for damages arising from the breach of their obligations under this contract, both those included in the previous clause and those specified in the rest of its clauses, and those derived therefrom.

The breach of any of these Conditions may result in the withdrawal or cancellation of the Services by Locking without prior notice to the Client and without giving rise to any right to compensation.

Furthermore, in the event of non-compliance with the rental period, improper use of the lockers, and damage caused to the lockers by Users, the following shall apply:

Non-compliance with the rental period:

If the User does not remove the items from the lockers within the rental period, the following rules will apply depending on the specific case:

  • If the User does not remove the items within 30 calendar days (inclusive) from the end of the rental: In this case, the items will continue to be safeguarded by Locking. For each day that passes from the expiration of the rental without the items having been removed by the User, until their collection by the User, an amount equivalent to the price of the uncollected locker will accrue per day, regardless of Trisanio S.L.’s right to claim the damages actually suffered.

Trisanio S.L. reserves the right to retain the items until full payment by the User of the amount owed.

Likewise, if the User requests the return of the items by shipping, the cost of return will be borne 100% by the User, and Trisanio S.L. will not assume any risk for the transport of the items.
If the User requests shipping, the transportation costs will be paid by the User prior to shipment. Furthermore, in this case, Trisanio S.L. will charge an amount of 300 Euros plus VAT for the service provided for having to manage the removal and delivery of the goods to the transport company. Trisanio S.L. reserves the right to retain the items until full payment by the User of the amount owed.

  • After 31 calendar days (inclusive) from the moment the rental period ended, without the User having claimed the return of the items, it will be understood that the goods have been abandoned by the User for all purposes.

Should this occur, Trisanio S.L. may dispose of them as it deems appropriate or convenient, depending on the type of abandoned goods, with full indemnity for Trisanio S.L.

Non-compliance with the proper use of lockers:

Trisanio S.L. reserves the right to remove any object that does not comply with the locker use regulations and is a prohibited object. Should this occur, Trisanio S.L. will be authorized to call the police or competent authority and report the conduct, as well as to remove the prohibited objects, disposing of them as it deems appropriate or convenient, with full indemnity for Trisanio S.L.
The User will be responsible for the objects they insert into the lockers.

In any case, the removal of prohibited items will entail a penalty of 300 Euros, a penalty that will not exclude the breaching User’s obligation to indemnify, allowing Trisanio S.L. to dispose of them as it deems appropriate or convenient, depending on the type of abandoned goods, with full indemnity for Trisanio S.L. for the damages actually caused.

Damages caused to the lockers and/or premises by Users:

The User will be fully responsible for any damages or deterioration they may cause to the lockers due to their improper or inadequate use and to the commercial premises. Should this occur, the User must compensate Trisanio S.L. for the physical damages caused to the locker(s) and/or to the commercial premises, as well as for loss of profit.

In particular and without limitation, the User causing the damage must pay Trisanio S.L. a penalty of the daily rental fee for each day the locker is rendered unusable, which is set at 100 Euros per day, as well as the cost of repair or replacement, which is quantified at 1,000€ in case of replacement, all without prejudice to any greater damages that may be proven.

Damages that the User may cause to the premises due to their improper or inadequate use will be penalized with a minimum of 400 Euros, and this amount may be increased up to the amount that Trisanio S.L. can justify the damages.

Payment of penalties:

The penalties detailed in this section will be paid by the User using the same payment method as that used by the User when contracting the service or by bank transfer to the account indicated by Trisanio S.L. if requested by the User. The User expressly accepts that Trisanio S.L. proceeds to collect the amounts established in this section using the User’s card or payment method when contracting the service and presents, if the User requires it, a breakdown of the expenses incurred and the penalties applied.

OBLIGATIONS OF TRISANIO S.L.

Trisanio S.L. undertakes to keep the locker service active and to provide the User, for the contracted period, with the locker(s) the User has rented in good working order.

Furthermore, Trisanio S.L. undertakes to resolve any incident that may arise in the use of the lockers as quickly as possible.

LIMITATION OF LIABILITY OF TRISANIO S.L.

Trisanio S.L. offers a locker space rental service and is not responsible for the safekeeping of items. The User is solely responsible for the goods they place in the rented lockers.
In the event of theft, loss, or deterioration of stored items for any reason, the User must file a report with the competent authorities.

Trisanio S.L. offers a 24-hour, 365-day-a-year video surveillance service, which the User expressly accepts. Therefore, should the competent authorities require said recording, it will be sent to them as soon as possible by Trisanio S.L.

INAPPLICABILITY OF THESE GENERAL AND SPECIFIC CONTRACTING CONDITIONS

Users who have not reserved their locker through the means offered by Trisanio S.L. (website or at the commercial premises itself, using the provided software) will not be considered Clients of Trisanio S.L. and, therefore, these General and Specific Contracting Conditions will not apply to them.

In particular, the following will not be considered Clients of Trisanio S.L.:

  • Individuals who accept the reservation code provided by another User, either because this User is leaving the locker or to share it.
  • Individuals who leave their items in an open locker without prior reservation and do not call Trisanio S.L. to try to resolve such an error.
  • Individuals who leave their items outside the lockers provided for that purpose.
  • Individuals who are on the premises for purposes other than reserving a locker and using it.

CANCELLATION/REFUND

Can the User modify their reservation or withdraw from it?

Once the reservation has been made and confirmed, the User cannot modify or withdraw from it.
In the event that the User wishes to modify their reservation once made (change of dates or contract more or fewer days than initially contracted), they must cancel the reservation and make a new one.

COMPLAINTS

If the User believes they have reasons to file a complaint, they may do so by sending an email to the following email address: info@locking.es.
Trisanio S.L. will try to resolve the incident and find a satisfactory solution for the parties.

If the User is not satisfied with Trisanio S.L.’s response, they have the option to file a complaint form with the consumer authorities of the Community of Madrid. The corresponding form can be obtained through the following link:

LANGUAGE

The language in which the contract between Trisanio S.L. and the Client will be finalized is Spanish, even if the Client has chosen any other available language on the touchscreen to navigate it.

INDUSTRIAL AND INTELLECTUAL PROPERTY

The industrial and intellectual property rights over the works, trademarks, logos, and any other protectable elements contained on the website and in Locking’s commercial premises belong exclusively to Locking or to third parties who have authorized their inclusion on the website and/or in the commercial premises. Unauthorized reproduction, distribution, commercialization, or transformation of such works, trademarks, logos, etc., constitutes an infringement of the industrial and intellectual property rights of Locking or their owner, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, the information to which the Client can access through the website and the touchscreen located in the commercial premises may be protected by industrial, intellectual, or other property rights. Locking will not be responsible in any case and under any concept for infringements of such rights that the user may commit.
